First legal step for non-registration in RERA Act 2016 has been taken in Maharashtra. Sai Estate Consultant of Maharashtra has been issued with the show-cause notice for violating the provisions of Real Estate (Regulation and Development) Act 2016 and the state rules formed under the Act. As per RERA Act 2016, no property broker or agent is allowed to advertise the projects without getting the project registered. The property broker Sai Estate Consultants has been charged for advertising a multiple residential building that has not been registered under Maharashtra Real Estate Regulatory Authority (Maha-RERA). Although the broker has already registered himself with the authority. The Act requires the broker to sell or facilitate such activity in registered projects regarding which Completion Certificate has not been received.
Gautam Chatterjee, chairperson, MahaRERA, clarifying ET in a conference that even though ongoing projects have a 90-day window to advertise, sell and also get registered with the authority, if any broker has got registered during this period, he as per the rules can facilitate the sale only in such projects that are registered hence the broker has violated Sections 9 and 10 of the Act and Rule 14 of the registration regulation.”
A total of 22 real estate projects and over 1100 property brokers have registered under the newly established Real Estate Regulatory Authority (RERA).
