Judicial officer not yet appointed in Gurgaon RERA Bench

Gurgaon RERA: H-RERA (Haryana Real Estate Authority) after four months of wait nominated the chairpersons and members of authority on November 2017, although wait was even longer as authority took charge on 5th February 2018. In Gurugram 300 complainants of homebuyers have been received by the authority but no judicial officer has been appointed to grant relief to complainant.

As per rules of the state a retired judicial officer of rank district judge or additional district judge need to be appointed as RERA Registrar who would be responsible for registering complaints and issuing notices, based on which the H-RERA chairman and members will conduct hearing to address the grievance. There is a great importance of Registrar as without the officer H-RERA is unable to register complaints (currently it is only receiving complaints) and not able to provide the grievance. Six law graduates are helping complainant to file complaints as writ petition but due to lack of Judicial officer homebuyers have to wait for resolving of the grievances.

Although authority has fixed 60 days for hearing of complaint and providing relief to home-buyers, but till now, hasn’t been able start work on resolving any grievances. As per the authority the official will start resolving the issues but they are silent on appointment of registrar. Due to lack of appointment of the officer complaints are increasing and as a delay in decision making is done. Home buyer might have to wait even longer as of now.
