REVISED RERA REGULATION FOR PROJECT REGISTRATION UNDER HARYANA RERA

In yet another big change in RERA Laws in Haryana, the RERA authority, Panchkula has notified new “The Haryana Real Estate Regulatory Authority, Panchkula, (Registration of projects) Regulations, 2018 prescribing – 

 

(i)                 Revised Form REP-1 for registration of project

(ii)               New requirement of documents for registration of project 

(iii)            Additional/New regulations to be followed by builders and complainant

 

Previously, the Government of Haryana has constituted two RERA authority (i) RERA authority, Gurugram which would be jurisdiction only in the district of Gurugram and (ii) RERA Authority, Panchkula, which would be applicable to rest of Haryana.

 

Notices are being sent to the registered as well as pending project to submit fresh file with all the related documents. The new requirement as per revised regulations are very big and require projection of entire project till completion.

 

Among other existing details, some of the documents are explained here-in-under for your kind reference.

 

1.      Project launched during last 5 years – As compared to old form, now complete information regarding project in last 5 years has been asked for which should be certified by Chartered Accountant, some of details are :

          Amount collected, estimated/actual cost, loans sanctioned by banks, Source of deficit or application of funds, handover schedule

          Litigation details for the projects

          Explanation for the delay

 

2.      Details information for facilities – The details of facilities to be provided shall be required to be provided in very detailed manner, including the size, name of agencies to execute, comparison of planned and actual development of facilities etc.

 

3.      Areas-wise Breakup of project –  Complete breakup of project shall be provided regarding the uses, estimates, facilities which should be evidenced by environment clearance. 

 

4.      Time schedule of completion of project – The time bound completion schedule shall be required to be submitted. These details are directly linked to the withdrawn of money from account. It requires complete project and analysis of different scenario, like

 

             How to compensate if the land is owned by company

             What if the unit is sold when the project is near completion

             Effect of bank loan etc.      

 

5.      Apartment/units details – Complete information in the following details (in prescribed format) for every kind of apartment shall be provided:

          Architectural details

          Structural Details 

          Construction specification 

          Finishing details 

          Service

          Lift

          Fire 

          Electrical 

Each small detail for every kind of apartment shall be provided. 

 

Apart from above details, every other detail which were required as per old form REP-1, has been made with details. RERA registration is not just a submission of documents but forecast of complete project for its completion, financial and deliverables. Hence be very careful.
