In UP RERA, a separate department has now been made to look into the matters where the execution of the order has not been done.
Not mentioning the date of giving possession to the buyer is a clear matter of fraud and misrepresentation and as per the Maharashtra Ownership of Flats Act of 1963.
In many of the instances, the RERA Authorities receives the complaint of the projects which were handed over long ago before the RERA.
The authorities of most of the states have passed numerous orders but none of them have been executed in reality. The orders remain on paper and developer/ promoters have not complied the order.
The high court upheld the decision of the Appellate tribunal by directing the builder to deposit the 50% of the refund amount as ordered by the authority in order to hear the plea.
The Gurugram RERA known as H-RERA is about issue a notification for the builder who are trying attracts the home buyers by making an offer of ‘Assured Returns’.

Although, the home-buyers are taking a sigh of relief but what if there is no Builder-Buyer agreement executed between the Builder and buyer.
The Lucknow bench after hearing a series of complaints against Ansal’s in particular, it has ordered for the forensic audit of the builder, as the bench thinks the homebuyer is genuine hence it has put restrictions upon the activities of the Ansal.
TNRERA has come to the conclusion that the builders/promoters are not allowed to split the project until the consent from the two third buyers of the project have been obtained.
IBC and RERA Act, enacted in 2016, appear to be pitted against each other as far as protecting the interests of bankers and home buyers are concerned.
RERA Authorities are functional in almost all states. The authorities though being on nascent stage are trying their best to deliver justice to all the aggrieved homebuyers.
In the cases against Ansal API Group one of the member Mr. Balwinder Singh has ordered Ansal Properties & Infrastructure Pvt. Ltd. to dispose off the grievances of the allottee within a week.
At present there are more than 4000 projects and 600 real estate agents being registered with the HRERA authority. Though the registration will not affect the remedy and a complaint can filed against any developer.
