"The Complainant has purchased an apartment bearing no 307-I in the Respondents project 'Ekta Parksville Phase III' located at Virar, through an agreement for sale dated July 02,2073 pursuant to which the date of possession was December 2016 but repossndent failed to handover thhe possesison and has now put a revised date of completion of the project as June,2020. Therefore, complainant intends to withdraw from the proiect. The respondent explained the reasons, beyond his control, due to which the completion of the project has got delayed. After detailed deliberation between the Complainant and the Respondent, the parties have mutually agreed to possession date of October 31, 2018."
"Authority held that the Respondent has to handover the possession of the said flat to the Complainant before the period ending October 2018, failing which the respondent shall be liable to pay interest to the Complainant from November 1, 2018 till the actual date of possession, on the entire amount paid by the Compiainant to the Respondent. The said interest shall be as prescribed under Rule 18 of the Maharashtra Real Estate (Regulation and Development) (Registration of Real Estate Projects, Registration of Real Estate Agents, Rates of Interest and Disclosures on Website) Ruies, 2017. Respondent shall not demand further payments from the complainant till handing over possession of the said apartment."
