Flat buyers in Mumbai are now moving to High Court in the absence Real Estate Regulation and Development Act (RERA) tribunals to defend the orders of Maharashtra RERA (MahaRERA).
From the commencement of RERA Act i.e. 01/05/2016, it was made mandatory for all States to establish an appellate tribunal within a year to simplify and make efficient the process of disposal, rather than complicating it for common home-buyers. Regrettably, even after the stipulated period, the tribunal is not in place.
MahaRERA adjudicating officers have pronounced several orders under RERA, many of which are being challenged in the Bombay high court in the absence of a tribunal.
A senior government official said the administration was setting up a tribunal. He said till it comes into place, the state was assessing if any other tribunal, such as the revenue tribunal, can be given additional responsibility.
Officials said there was a provision in RERA Act to appoint another tribunal to handle RERA cases till the RERA Tribunal comes into being. No other state has set up the tribunal.
