On the first seating the Greater Noida bench of the UP-RERA heard 31 complaints all against a Noida-based developer that has failed to deliver three projects in the past 10 years such as Earth Sapphire, Earth Towne and Earth Tech One projects. The bench, headed by member Balwinder Singh said “Our proposal to the state government and other responsible bodies in case of Earth Infrastructures would be first to try and involve an external agency to get the pending work completed. If that does not work, the last resort should be to liquidate the project and other holdings of the company to pay the buyers back.
Buyers of Earth Sapphire have mostly complained about the builder not meeting its promise of assured returns.
On the remaining complaints, Mr. Singh said, “We may hear them again later. It is a difficult case as all four directors of the real estate company are at present lodged in jail. To take matters to a closure, we may need their presence.”
