Rajasthan High court stays the order passed by RERA Appellate Tribunal

The division bench of Rajasthan High court stayed the order passed by the RERA Appellate Tribunal as it was not constituted as per the provisions of the Act. As per section 46(1) of RERA Act, the Chairperson of the Appellate Tribunal is or has been Judge of the High Court. On this sole ground the order has been stayed. Further the petitioner had stated that the tribunal should have been constituted within one year of the passing of the Act by May 2017 but till now it has not been done.  The Court further observed that the government failed to comply with the Act.
