The first set of regulation in real estate industry has become reality now. The “Real Estate (Regulatory & Development) Act, 2016 has commenced from 01/05/2017. According to the Act notified by the central government, all real estate projects including the older ones should come under the ambit of the RERA.

Now real estate project and real estate agent need to comply RERA Act and State Rules. The RERA Rules and RERA authority has been prescribed by Haryana Government. Yes, the new government is thinking to bring some changes in such rules.

Being one of the hubs in real estate projects, Haryana deserve a separate analysis of RERA Registration in Haryana, which is as under;

  • Who is required to get RERA Registration?
  1. Every Promoter:
  • The contractor for construction or demolition of building, plot etc.
  • Developers of land
  • Any development authority or public body who construct or sold building, plot
  • State-level or primary co-operative housing societies
  • Holder of power of attorney for sale from the land owner
  1. On-going project as on 01/07/2017 where completion certificate has not been received.
  2. Every agent who assist in sell/purchase of any RERA registered real estate project
  • RERA Fees and procedures

For Real Estate Project – The RERA registration fees shall be based on the land area to be developed

In case of plotted development of residential, commercial, industrial and the like uses projects, five rupees per square meter, but shall not be more than two lakhs rupees”

 

For Real Estate Agent – The RERA registration fees for Real estate agent in Haryana shall be Rs. 25,000/- for individual and Rs. 2,50,000/- for person other than individual.

The Time limit for RERA Registration is as under

    1. For On-going project – within 3 months i.e 31/07/2017
    2. For New project– before any advertisement or sell or booking
    3. For real estate Agent– before any transaction

        Please guide me how can I know that my project is under RERA and how can I complain against builder that my home is delaying too much.

  2. i booked my flat in Ansal’s Europa Residency project in Kundli, in 2009. The project is still incomplete, infact the tower where my fkat is allotted, has not gone beyond excavation till now.i have paid approx 17 lakh under the construction kinked plan. The project is till date not registered under RERA. Please can you suggest me on what are my options.

    1. Dear Sir, Although RERA authority limit its authority for delay before implementation of Act, Still you have option to file complaint before RERA and consumer Court.

  3. Can I file a complaint against a builder who has not yet got registered him self under RERA, Haryana. Please guide. Unable to find suitable window in HRERA site.

    1. There is no online portal for Haryana RERA for the time being. Hence you need to file complaint offline to the Panchkula office.

  4. Can you pl let me know if any specific date for HRERA/RERA registration has again be fixed. Shall be grateful if information could be pro used ASAP.
