Simple Steps of How to Get RERA Registration

Until May 2016 there were proposed bills for regulation and promotion of the real estate sector to ensure fair deal between buyers and sellers in a more transparent manner. In May 2016 Parliament enacted an Act Known as Real Estate (Regulation and Development) Act, 2016 which has come in force with all its 92 sections from 1st of May 2017 across India. According to that Act every promoter and agent selling property in different states of India has to first get their projects registered with that State RERA Authority. So far, 14 states and Union territory such as Maharashtra, Madhya Pradesh, Delhi, Uttar Pradesh, Gujarat and Bihar have notified their rules with RERA and many others have issued draft which is yet to be notified.

The Intention for the implementation of RERA is to make Builders more accountable for the timely delivery of the projects and to protect buyers from fraud sellers. For that purpose RERA Authorities has prescribed a simple and transparent procedure for registration of Real Estate Projects and Agents.

All commercial and residential real estate projects will have to register by submitting documents along with the prescribed fees except in projects where:

  • The promoter has received completion certificate of the project prior to commencement of Act
  • The area of land proposed to be developed does not exceed 500 sq. mt
  • The number of apartments is not more than 8
  • Any repair or renovation of an existing building or structure that does not require marketing, advertising and selling of any apartment or plot
Documents required for registration under RERA

The following documents are required to be submitted in triplicate:

  • PAN Card of the builder
  • ITR of last 3 years and the balance sheet of the builder
  • Builder must clarify about the apartment (carpet area, number of floors, parking space)
  • Declaration by the builder of having legal title of the land with proof
  • Details of the land (rights, title, mortgage)
  • If the builder is not the owner of the land, the consent letter of the actual owner with documents will be required
  • Details of the project (location, sanctioned plan, layout plan)
  • Ownership documents (proforma of allotment letter, agreement of sale)
  • Information of the persons involved (Architects, Engineers and others)
Registration Process for Real Estate Agents
  • File an application form along with fee and documents to get registered with RERA
  • You will receive a registration number from the regulator. This need to be mentioned in every property sale
  • On a quarterly basis, you are required to maintain the books of account, records and documents related to the transactions
  • Share all the information and documents about the project with the buyer
  • Agent may be suspended for the misrepresentation or fraud during the registration process.

Further the center has clarified through a press release that the Promoters and agents are required to get their on-going projects registered with 3 months of the Act applies i.e. 31st, July 2017. Also Non Registration of Projects will attract heavy penalty under RERA Act.

  1. I am a real estate agent, my firm is proprietor ship firm , i have already registered my firm name and got user id and pw from maharera site. Now further what i have to do to get rera registration No.

        1. Please advice the entire process to get a Rera registration number for property agents along wity list of documents and charhges. Also want to know the validity.

    1. As per RERA regulations, the application for RERA regisration shall be approved or disapproved within 30 days of filing.

  2. We make a society with 12 menbers for making Ground plus 3 floors with 12 floots. Are we required to regustred with RERA.

    1. Yes, Mr. Jitender, if the size of land area is more than 500 Sq. mtrs or no. of flats are more than 8. You are required to get RERA registration.

  3. I am a real estate agent, should i register under RERA and if i register is it necessary to mention every sale that i do ?

  5. I HAVE CONSTRUCTED BUILDING CONSISTING 15 FLATS ON 650 SQMT PLOT AT VILLAGE VABHAVE VAIBHAVWADI SINDHUDUGA MAHARASHTRA.
    THE WORK STARTED IN 2011 WITH PLAN APPROVAL FROM GRAMPANCHYAT AND PRANT ADHIKARI(SD0) AND PROJECT COMPLETED IN 2013.
    I HAVE WRITTEN LETTER TO GRAMPACHYAT IN 2013 FOR COMPLETION OF WORK AND GIVING ASSESSEMENT CERTIFICATE BUT TILL TODAY I HAVE NOT RECEIVED ANY CORRESPONDENCE . NOW THE VAIBHAVWADI HAS BECOME NAGAR PARISHAD.
    1.I HAVE NOT RECEIVED ANY LETTER FROM GRAMPACHYAT TILL TODAY.SHALL I TREAT THAT IT IS APPROVED ASPER GRAMPACHAT ACT.
    2.WHETHER I HAVE TO REGISTER FORM RERA.
    3.OUT OF 15 FLATS I HAVE SOLD 7 FLATS.AND OUT OF IT 5 BUYERS HAVE TAKEN POSSESSION ALREADY AND 2 BUYERS ARE STILL TO PAY INSTALMENT THUS POSSESSION IS NOT GIVEN TO THEM.
    4.THE 2 BUYERS HAVE COMPLAINT THAT THE PROJECT IS NOT REGISTERED.

    1. IF you have not received the occupation certificate or completion certificate, then the project would fall under “on-going project” for RERA and shall be required to get registered. For more information, please mail us at rera@centrik.in

  6. I HAVE DONE WITH REGISTRATION PROCESS AND EVEN WITH THE PAYMENT PART ,MY QUESTION IS AFTER COMPLETION OF THIS PROCESS FROM WHERE U GET A REGISTRATION NUMBER AS I AM UNABLE TO FIND IT ON WEBSITE SO.

    1. Please tell us in which state you have done the registration, then only we can reply accordingly as RERA websites of different states have a different user interface.

  7. If I am a developer investing money only and I have my gst registration number and land owner is another person on 60/40 percent I m constructing the building. Now in my percent I am getting only 5 flats and 2 shops I need to do the rera registration plz reply

  11. I submitted the registration application of Maha RERA as Agent – Other than Individual.
    After scrutiny , Maha RERA mailed the error to upload the ITR of company and not individual .
    Query- Company is in existence for less than a year therefore, no ITR.
    What can be done?

  15. We are a private limited company and the land is in the name of the company and we are going to develop the land to PLOTS and applied for CMDA, Chennai. We are going to sell the PLOTS only. shall we need to register RERA? please clarify.
