After facing a lot of criticism for leaving almost 90% of the residential projects going on in the city outside the ambit of the RERA Act, 2016, it is said by the Haryana Government that after the judgment of the Punjab and Haryana High Court is delivered the ongoing projects which has not received a completion certificate yet will be included under the purview of RERA.
As Gurgaon Citizens’ Council (GCC), which is a public representative body of licensed colonies, has moved to the Punjab and Haryana High Court, seeking implementation of RERA Rules, this leaves the buyers hopeful that the government will include the non-registered projects under RERA. The hearing of the matter is on February 20.
The Bombay HC has already ruled out part-completion of the projects as the basis of exemption from RERA registration as the Act clearly states that projects that have not received a completion certificate yet will be considered as ongoing projects and the projects which has received the completion certificate is the only basis on which a project can be exempted from RERA.
Out of 1000 ongoing projects in Gurgaon and almost 300 new projects, so far, only 254 new projects have been registered.
