Cases of Civil nature doesn’t fall in RERA
MAHARERA: Chitra Singh, gazal singer Jagjit Singh’s widow and her grandson Armaan Chowdhary went before the Maharashtra Real Estate Regulatory Authority (MahaRERA) requesting a refund of Rs 1.75 crore paid to a developer. The complaint was dismissed by the regulator stating that the case is of civil nature and does not include any violation or contravention of any provision of RERA Act, 2016.
Mrs. Singh and her grandson had made payments in lieu of two flats. As per the complaint, they have booked two flats in Sai Siddhi Developers’ Goregaon development project in 2013. In 2015, they negated the booking after recognizing that the developer had authorizations only till eighth floor, whereas their flats were booked on the tenth floor. After requesting refund from the builder upon cancellation of the booking, in 2016, the developer gave them cheques, which were dishonoured. Singh then went before the regulator last month looking for directions for refund of money along with interest.
