The relevant documents which are required to be filed are ready with the company and company is willing to file the same, if so permitted.
Further, accounts of the company are audited and have been approved by the members within the prescribed time. The company has not deposited heavy cash during the demonetization period i.e. 08/11/2018 to 31/12/2016. Registrar of Company (ROC) has given it no objection to restoring the company.
National Company Law Tribunal (NCLT), Mumbai bench in CP no. 526/252/NCLT/MB/MAH/2017 vide order dated 15/11/2017 considering facts allowed the restoration of the petitioner’s company in the Registrar of Companies maintained by ROC subject to filing all the documents and payment of Rs. 10,000/- within 7 days.
Consequently, thereupon the bank account’s if frozen shall get defreeze and to be operated by the petitioner.
