The interim Haryana Real Estate Regulatory Authority (H-RERA) has slapped notices on 140 residential projects across the state for “not applying” for registration under the Act.
Sources said that most of the registrations applied are either “incomplete” or were in “wrong format”. All these projects are currently under construction and haven’t received any occupation certificate. Accordingly officials aforesaid that with the interim authority, all the developers in question have been asked to either submit fresh/complete applications for registration at the earliest. “We have issued notices in all those cases where registration is mandatory under the Act but the developers concerned haven’t filed any application. There are also a few cases where the applications submitted were incomplete,” said a senior official working with the interim authority.
As per the H-RERA, all projects which did not have an occupation certificate or had not applied for an Occupation certificate as on the date of the notification of the Act would come within the purview of the Act.
Earlier, the authorities had issued notices to some developers for advertising their projects, both new and existing, without registering them under RERA. Under Section 3 of the Central Real Estate Regulation Act, no developer can advertise a project for sale unless registered under RERA.
Till October, the interim authority has received a total of 600 applications, excluding the incomplete ones, for registration. While 345 projects have been cleared and given registration certificates, the remaining 155 applications are still under process.
According to industry insiders, the government currently does not have any specific number of projects that fall under the RERA in the state. “The interim authority is now working on a list of ongoing projects, which do not have occupation certificates, so that they can have a definite number of the projects under RERA,” said the source.
Meanwhile, the deadline for setting up of the state RERA has been extended and the authority is expected to be in place by November-end. According to senior government officials involved in the proceedings, the process of appointing officials is under way and interviews for some top posts are going on. Once the authority is ready, the RERA website will take another month or two to be functional.
